1. Parties and acceptance

These Terms of Use govern the relationship between [Ticari Unvan] (address: [Adres]; tax office / tax number: [Vergi Dairesi] / [Vergi No]; MERSİS number: [MERSİS No]; telephone: [Telefon]; email: [E-posta]; KEP address: [KEP adresi]), which operates the BM Turkiye website (the “Site”), and the person who visits or uses the Site (the “User”). By using the Site you are deemed to have accepted these terms; if you do not accept them, do not use the Site.

2. Site content and medical notice

The information on the Site, treatment descriptions, price and duration information and before/after images are for general information only; they are not medical advice, a diagnosis or a promise of treatment. Treatment outcomes vary from person to person and a particular result cannot be guaranteed. A personal treatment plan and its price are determined only after the dentist’s examination.

We take care to keep content accurate and up to date, but we do not promise that it is error-free or uninterrupted. We reserve the right to correct an obvious error (such as a typing or price error); the amount shown before payment is the price in the contract concluded with you.

3. Appointment requests and contact forms

Enquiries made through forms or messaging channels are only requests for information and appointments; they do not create a health-service contract without the clinic’s approval and confirmation of the appointment. Treatment begins only after the examination, information and informed consent when you attend the clinic. You are responsible for the accuracy and currency of the information you enter in forms.

4. Online payments

Online payments are made through a payment link for an amount set by the clinic, or through the payment page for an amount you choose. Before paying, you must read and confirm the Distance Services Contract, the Pre-Information Form and the Cancellation and Refund Terms. Payment is made on the bank’s 3D Secure page; your card details are not entered or stored on our site. The rules on withdrawal, cancellation and refund are set out in the relevant contract and terms; using the Site does not change them. Payment links can be used only once and only within the stated period.

5. User obligations

The User agrees to give accurate information, not to make an unauthorised enquiry or payment on behalf of someone else, not to use the Site for unlawful or immoral purposes, not to attempt anything that harms the security or operation of the Site (such as unauthorised access, automated scraping or malicious software), and not to upload content that infringes the rights of others. When uploading photos, X-rays and documents through forms, you must make sure they are your own or that you are entitled to share them.

6. Wheel and campaigns

Campaigns such as a prize wheel may be offered on the Site. The prizes, validity dates, terms of use and entry rule (for example one entry per telephone number) are shown during the campaign. Prizes cannot be exchanged for cash or transferred and are not valid outside the conditions shown in the campaign. If misuse, multiple entries or false information is detected, the prize may be cancelled. The data processed when you take part in a campaign is described in the “KVKK Information Notice”.

7. Intellectual property

The text, images, photographs, videos, logos, trademarks and design on the Site belong to [Ticari Unvan] or its licensors and are protected by intellectual property legislation. They may not be copied, distributed, modified or used commercially without written permission; viewing for personal, non-commercial purposes is allowed.

8. Third-party links

The Site may contain links to third-party sites or services (for example the bank’s payment page, maps and social networks). We are not responsible for the content or privacy practices of those sites and we recommend reading their own terms before using them.

9. Limitation of liability

To the extent the law permits, we are not liable for indirect loss caused by the Site not operating without interruption or error, technical failures or the fault of third parties. This limitation does not affect your rights arising from intent or gross negligence, bodily injury, or liabilities that cannot be limited under consumer legislation and mandatory provisions.

10. Governing law, disputes and changes

Turkish law applies to these terms. For disputes arising from consumer transactions, the Consumer Arbitration Committees and Consumer Courts have jurisdiction within the announced monetary limits; for other disputes, the courts and enforcement offices of [İstanbul] have jurisdiction.
